We know that fuel isn't needed to flee a battle, so perhaps with less than 5 fuel it simply takes more time to open the larger rift needed by the flagship. Then you are out of fuel in true space in the middle of nowhere, or what?

(It would be interesting if that were reflected in the game mechanics, ie you take longer to warp out if you have less than 5 fuel.) And you don't need fuel in truespace.
