Using images/video's/content from star-control.com
« on: January 29, 2005, 04:32:40 pm »

Greetings fellow SC fans

Ok, I am a freelance UK journalist currently in the process of writing the ultimate Star Control history article for a printed magazine, and wanted to know which content I can and cannot use for the article.

www.star-control.com has a vast ammount of usefull imagery that would aid me immensly in the writing of this article, but its not so easy to get in contact with the owner of it. Ive emailed the only email adress I could find, but thought it best to post here as well.

I am reffering specificaly to the following:

* in-game screenshots that are unmarked
* concept art
* StarCon videos (who owns these?!)
* photographs of gameboxes and other merchandise
* box scans

Now, the in-game screens, artwork etc are property of TFB, whom I am in contact with and wont mind me using them. But what about the videos and other screens?

I will of course credit any website I use content from, and I will of course be linking to the UQM website so people can dload the game. But I need to double check this.

Who must I ask in order to use certain visual content?

if anyone wants to email to discuss this, use:
megacdman[at]hotmail[dot]com

And please keep this quiet without spreading it all over the net, nothing is definite yet and being a freelancer means I have no guarantee of this being published, especially if someone else uses the idea first before my hard work reaches fruition.

I guarantee though it will be comprehensive and will do the series justice, something for fans and newcomers alike.

In game screenshots you can make yourself; I bet British copyright law has some fair use clause this falls under.
The game packaging and manuals of the PC version are owned by Atari if they're depicted on photos you'd probably need their permission as well as the permission of the person who took the photo. I suspect most of the photos on www.star-control.com are made by Chad Derrenbacker (the webmaster of that site). He doesn't respond on email very quickly, but he will usually respond eventually.
The Videos and, game packaging and manuals of the 3DO version are probably owned by Crystal Dynamics (though Atari may have some claims there too; ask TFB to be sure).

Note that there have been other magazines who have written about SC recently (with a copy of UQM included), but I don't recall any British ones.

I also suggest you let some people here proofread your article. Together we know a lot of the game and its history.

Thanks for the reply.

You mean US magazines have featured SC2 with a free copy of UQM?  :-/

Hmm, that might set me at a slight disadvantage... as long there have been none in the UK yet though I reckon its unique to go ahead with.

Another question is the many logs on star-control.com with FF, PR and other people. Who owns the rights to those logs, and can I freely use any quotes from them?

As for proof reading, once its complete, Id love it if someone could give it a quick read through before I submit it to my editor. Leave an email and Ill pass it on to you.

thanks for the info so far.

Sorry for the double post...

TFB agreed to answer some of my questions I sent off to them, and I have only now just discovered that several of them have already been answered in the dialogues found on the SC site, is Mr Derrenbacker the man I should ask about using parts of these QA sessions?

I don't recall any US magazines. I know for sure there was one magazine from Israel, and I think one in Finland. I was going to add here that there was even at this moment another person who mailed me about a similar idea for a magazine I assumed was in the US, but I just realised you were that person (my real name is Serge van den Boom, so you've got my email too).

As for the dialogs, that's really a legal question, and I'm not an expert at that in any country. But I suspect citations are fair use.
I don't know the origin of all those dialogs. Some were mail exchanges between people, in which case I'd think the parties of those emails have the copyright. As for the IRC chat logs, I don't know whether anyone can claim copyright on them. They're automatic logs of what was said in a public forum (though perhaps formatted and cleaned up). For the last IRC session with TFB I was the person who made the log; for the others I don't know.

Ahh yes, I remember!

Anyway, glad you cleared that up, for a moment I thought that the market was saturated with magazine features. If you feel that the UK market could still do with an expose on UQM then I will put all my effort into this article.

I will also email you a copy of the first draft, as a fan I'm honoured to be writing it, but its always good to get other fans perspective on things, make sure it hits just the right note.

cheers for the info!

I expect that you'd be the first in the UK with an article in a paper magazine. So that's a yes.
