StarCon FanArt, Use???

Hello all me Charrio again, i didn't want to post this in the other FanArt Thread.

I was wondering, what are the rights on StarCon, and if i wanted to use my work for say shirts or a poster, can I?

I know StarCon is in the Creative Commons, and as long as one doesn't make cash off the game, but what about  Art? Also, if i made NO profit can i still offer the art for shirts ect?

Just wondering, cause i want a Tiggs Shirt, lol

I assume that with "StarCon" you mean UQM; there was a cancelled project named "StarCon" which was intended to be a sequel to SC3.

It is the artwork which is distributed under a Creative Commons license, not the game engine, which is released under the GPL. And "Creative Commons" license in itself doesn't mean much, as there are several Creative Commons licenses. The license UQM is using is CC BY-NC-SA 2.5, which requires attribution, does not grant you the right to commercial use, and requires derivatives to be licensed under the same license.
Unless the creator of the fanart acquired separate permission from TFB, fanart based on the UQM artwork would be a derivative work, so a right to commercial use would not be granted by this license.

I think that non-profit use on t-shirts would not be a problem, not to mention personal use (no distribution).

There is always the option of asking TFB and the creator of the fanart for special permission for commercial use. They may want a share of the profit (and why shouldn't they?), but given that, something could probably be arranged. It may be a good idea to consult with the copyright owners anyhow, just as a courtesy, if nothing else.

Note that all of the above is as I understand it; I am not a lawyer; I may be wrong.

I drew the art, so i am the artist, it is based on the old animation graphics in SC2, or the UQMs.
The character is mine, the race Shofixti is part of the Star Control Universe tho.

So do you happen to know who i should Email?
