The emergency hyperspace device should concume 5 fuel units , but the thing is even if you have no fuel at all , you can still warp out . What gives ?

The guys at TFB were on a deadline so they have never finished Star Control 2, so the bug you state here was still there when it shipped .

It does consume 5 fuel though, right? Except if you have less than that, it consumes all of it.

But that's not what happens, right?
We know that fuel isn't needed to flee a battle, so perhaps with less than 5 fuel it simply takes more time to open the larger rift needed by the flagship.

So what happens if you run out of fuel in hyperspace and then some other ship pulls your ship back into true space? Then you are out of fuel in true space in the middle of nowhere, or what?

I don't think fuel is needed to create the Hyperspace portal. I think it's only needed to create it quickly. (It would be interesting if that were reflected in the game mechanics, ie you take longer to warp out if you have less than 5 fuel.) And you don't need fuel in truespace.
